These Terms of Service ("Terms") govern your access to and use of Al Amaanah ("the App", "the Software", "the Service", "we", "us", "our"), a masjid management software-as-a-service platform operated by Al Amaanah for Indian Islamic communities. "Client" means the masjid, madrasa, or Islamic organization that subscribes to the Service, together with its authorized administrators, staff, and members ("Users", "you").
1. Acceptance of Terms
By accessing or using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App. If you accept these Terms on behalf of a masjid or organization, you represent that you are authorized to bind that organization.
2. Service Provider
Service Provider: Al Amaanah (Indian Islamic community SaaS)
The Service Provider grants the Client a non-exclusive, non-transferable, revocable right to access and use the App during the subscription term, solely for the Client's internal masjid and madrasa administration.
3. Scope of Services
The App provides cloud-based tools for masjid and madrasa management. Core features include:
Administration & Dashboard — role-based home screens, user management, masjid profile and settings.
Member & People Management — member/people directory, profiles, roles, employment records, and app-access control.
Attendance — jama'ah attendance tracking and per-member history.
Finance & Donations — income/expense transactions, donor profiles and giving history, monthly budgets with threshold alerts.
Finance Reports — PDF, CSV, and XLSX exports and individual transaction receipts.
Communication — push announcements, notification centre, and delivery logs.
Madrasa Management — classes, students, subjects, attendance, exams, marks, report cards, leave requests, and teacher records.
Prayer Times — prayer time calculation, jama'ah schedules, and countdown display.
Nikah Certificates — marriage certificate issuance and PDF generation.
Audit Log — an immutable trail of administrative create/update/delete actions with attribution.
Complaints — member complaint submission and admin resolution workflow.
3.1 Technical specifications
Cloud-based SaaS; accessible via supported web browsers and the mobile app.
Mobile and web responsive design.
We aim to provide the App on a commercially reasonable, best-effort availability basis. We do not warrant uninterrupted or error-free operation and offer no fixed uptime guarantee (see Section 11). Scheduled maintenance may temporarily limit access.
All monetary amounts in the App are processed in Indian Rupees (INR) only.
4. Subscription & Pricing
Access to the App requires an active subscription. Subscription is activated by the Service Provider after payment is received and remains active until it expires, is cancelled, or is suspended under these Terms.
4.1 Subscription plans
₹459 / month — Monthly plan (30 days)
₹5,506 / year — Annual plan (365 days)
₹5,174 / year — Discounted Annual plan (365 + 30 days free)
A 1-week free trial is available for new masjids. All prices are in INR and exclusive of any applicable taxes. The Service Provider may revise prices for future terms with prior notice; price changes do not affect the current paid term.
4.2 Payment terms
Payment is due in advance, before service activation.
Payment is currently arranged offline / by direct arrangement with the Service Provider; the App does not yet process in-app payments.
Monthly plans: due on the 1st of each month. Annual plans: due at the beginning of the subscription year.
A 7-day grace period applies after a missed payment, after which the Service may be suspended.
4.3 Refund policy
Monthly plans: no refunds for partial months.
Annual plans: pro-rata refund within 15 days of payment if the Service is unused.
No refunds for suspensions or terminations arising from policy or Terms violations.
5. User Limits & Storage
Each subscription includes the following plan allowances:
User accounts: up to 1,500 authorized users.
Cloud storage: 10 GB.
Free trial: 1 week.
Additional capacity is available by arrangement: additional users at ₹50 per 100 users/month; additional storage at ₹200 per 5 GB/month.
6. Usage Restrictions
Community use only. The Software is licensed strictly for non-commercial administration by masjid, madrasa, and Islamic community organizations.
You must not:
Resell, lease, or commercially exploit the Software.
Sublicense the Software to third parties.
Operate the Software as a service bureau for unrelated organizations.
Reverse engineer, decompile, or attempt to derive the source code.
Upload malicious code, viruses, or harmful content.
Attempt unauthorized access to the Software, other tenants' data, or our infrastructure.
Share login credentials or PINs with unauthorized persons.
Store or transmit illegal content, or use the Software for unlawful purposes.
The Service Provider may suspend access immediately for violations and report illegal activities to the relevant authorities.
7. Data Ownership & Deletion
All data your masjid enters (members, donors, transactions, attendance, madrasa records, announcements, certificates, complaints, and settings) belongs to the masjid. We process this data on the masjid's behalf to provide the Service, as described in our Privacy Policy.
Account and tenant deletion follow the behavior described in Section 8 of the Privacy Policy:
When a masjid is deleted, it enters a 30-day window during which it can be restored and its data exported. After 30 days the masjid and all its data are permanently and irreversibly purged.
Deletion by the last active administrator of a masjid cascades to the entire masjid, removing every user account and all associated records.
A minimal technical record of the deletion event (masjid id, deleting user id, timestamp) is retained for platform integrity and abuse-prevention purposes only.
We do not provide a separate backup or data-recovery service beyond the 30-day window above.
Response time: we aim to respond within a reasonable time, typically within a few business days.
8.2 Software updates
Regular feature updates at no additional cost.
Security patches and bug fixes as needed.
Major updates communicated via in-app notice or email.
9. Intellectual Property
All intellectual property rights in the Software — including source code, design, documentation, and trademarks — remain the exclusive property of Al Amaanah. These Terms grant only a limited right to use the Software as a service and transfer no ownership of the Software to the Client.
10. Privacy & Data Protection
Your use of the App is also governed by our Privacy Policy, which explains what we collect, how we use it, and your rights. We comply with applicable Indian data protection law, including the Digital Personal Data Protection Act, 2023 (DPDP Act). The Client is responsible for obtaining any consents required from its own members for the data it enters into the App.
11. Liability & Indemnification
11.1 Service Provider's liability
The Software is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including error-free or uninterrupted operation.
To the maximum extent permitted by law, the Service Provider's total liability is limited to the fees paid by the Client in the preceding 12 months.
We are not liable for loss of data or revenue, indirect or consequential damages, or issues arising from the Client's own systems, devices, or internet connectivity.
11.2 Client's indemnification
The Client agrees to indemnify and hold the Service Provider harmless from claims arising from: violation of these Terms, misuse of the Software, infringement caused by Client data, or violation of applicable laws by the Client or its Users.
12. Term & Termination
12.1 Term & renewal
The initial term is per the selected subscription plan.
Subscriptions auto-renew unless 15 days' written notice is given before expiration.
Renewal is at the then-current rates.
12.2 Termination rights
By the Client: at the end of the term with 15 days' notice, or for material breach by the Service Provider (with 30 days to cure).
By the Service Provider: immediately for non-payment (after the 7-day grace period), immediately for material breach or policy violations, or with 30 days' notice for convenience.
12.3 Effect of termination
Access to the Service is suspended.
Any outstanding fees become due.
A 30-day data export/recovery window applies.
Data is permanently deleted after 30 days (see Section 7).
13. Dispute Resolution
13.1 Governing law
These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Indian Contract Act, 1872, and the Digital Personal Data Protection Act, 2023.
13.2 Jurisdiction
The courts of Kerala, India have exclusive jurisdiction over any matter not resolved through the process below.
13.3 Dispute process
Negotiation (15 days): good-faith discussions between the parties.
Mediation (30 days): through a mutually agreed mediator.
Arbitration: under the Arbitration and Conciliation Act, 1996 (seat: Kerala, India).
Litigation: only after exhausting the steps above.
14. Changes to these Terms
We may update these Terms to reflect changes to the App or legal requirements. Material changes will be communicated via in-app notice or email. The "Last updated" date above reflects the most recent revision. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
