Terms of Service

These Terms of Service ("Terms") govern your access to and use of Al Amaanah ("the App", "the Software", "the Service", "we", "us", "our"), a masjid management software-as-a-service platform operated by Al Amaanah for Indian Islamic communities. "Client" means the masjid, madrasa, or Islamic organization that subscribes to the Service, together with its authorized administrators, staff, and members ("Users", "you").

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App. If you accept these Terms on behalf of a masjid or organization, you represent that you are authorized to bind that organization.

2. Service Provider

The Service Provider grants the Client a non-exclusive, non-transferable, revocable right to access and use the App during the subscription term, solely for the Client's internal masjid and madrasa administration.

The App provides cloud-based tools for masjid and madrasa management. Core features include:

Access to the App requires an active subscription. Subscription is activated by the Service Provider after payment is received and remains active until it expires, is cancelled, or is suspended under these Terms.

4.1 Subscription plans

₹459 / month — Monthly plan (30 days)
₹5,506 / year — Annual plan (365 days)
₹5,174 / year — Discounted Annual plan (365 + 30 days free)

A 1-week free trial is available for new masjids. All prices are in INR and exclusive of any applicable taxes. The Service Provider may revise prices for future terms with prior notice; price changes do not affect the current paid term.

Each subscription includes the following plan allowances:

Additional capacity is available by arrangement: additional users at ₹50 per 100 users/month; additional storage at ₹200 per 5 GB/month.

6. Usage Restrictions

Community use only. The Software is licensed strictly for non-commercial administration by masjid, madrasa, and Islamic community organizations.

The Service Provider may suspend access immediately for violations and report illegal activities to the relevant authorities.

7. Data Ownership & Deletion

All data your masjid enters (members, donors, transactions, attendance, madrasa records, announcements, certificates, complaints, and settings) belongs to the masjid. We process this data on the masjid's behalf to provide the Service, as described in our Privacy Policy.

Account and tenant deletion follow the behavior described in Section 8 of the Privacy Policy:

We do not provide a separate backup or data-recovery service beyond the 30-day window above.

9. Intellectual Property

All intellectual property rights in the Software — including source code, design, documentation, and trademarks — remain the exclusive property of Al Amaanah. These Terms grant only a limited right to use the Software as a service and transfer no ownership of the Software to the Client.

10. Privacy & Data Protection

Your use of the App is also governed by our Privacy Policy, which explains what we collect, how we use it, and your rights. We comply with applicable Indian data protection law, including the Digital Personal Data Protection Act, 2023 (DPDP Act). The Client is responsible for obtaining any consents required from its own members for the data it enters into the App.

The Client agrees to indemnify and hold the Service Provider harmless from claims arising from: violation of these Terms, misuse of the Software, infringement caused by Client data, or violation of applicable laws by the Client or its Users.

13. Dispute Resolution

13.1 Governing law

These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Indian Contract Act, 1872, and the Digital Personal Data Protection Act, 2023.

13.2 Jurisdiction

The courts of Kerala, India have exclusive jurisdiction over any matter not resolved through the process below.

13.3 Dispute process

  1. Negotiation (15 days): good-faith discussions between the parties.
  2. Mediation (30 days): through a mutually agreed mediator.
  3. Arbitration: under the Arbitration and Conciliation Act, 1996 (seat: Kerala, India).
  4. Litigation: only after exhausting the steps above.

14. Changes to these Terms

We may update these Terms to reflect changes to the App or legal requirements. Material changes will be communicated via in-app notice or email. The "Last updated" date above reflects the most recent revision. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
